Sweden Rejects Detention Request For Assange

WIKILEAKS founder Julian Assange's rape claim will continue to be investigated but a Swedish court ruled that he will not be detained.

A statement from Uppsala District Court said today: "The court did not believe it was proportional to detain Julian Assange and therefore rejected the prosecutor's detention request".

The investigation will continue with him in absentia, Persson said, adding that she will also issue a European Investigation Order to interview Assange.

"The court said that the prosecutor had demanded his extradition too early", Assange's Swedish lawyer Per E Samuelsson told broadcaster Sveriges Radio.

Last month, the 47-year-old was evicted from the Ecuadorian Embassy in London where he had been holed up with political asylum since 2012.


He is now serving a 50-week sentence for breaching bail, just two weeks short of the maximum sentence.

Assange was given 22 weeks in the chokey last month, but it is seen as unlikely that he will be released from British custody while the American extradition proceedings against him go on, with the United Kingdom of the view that the bail-jumper is a flight risk.

The United States is also requesting he be extradited to the USA for violating the Espionage Act.

The court agreed with prosecutors that Assange could pose a flight risk, but said detention would not be proportionate, CNN reported.

Swedish prosecutors had closed the rape investigation in 2017 as they said they were unable to proceed without access to Assange, but they reopened the case in May after his arrest.

Assange remains in southeast London's maximum security Belmarsh prison.


The rape allegation still could be prosecuted; the statute of limitations expires in August 2020.

The decision of whether to extradite him to the United States or Sweden would rest with the UK interior ministry.

Assange is wanted in Sweden on suspicion of "intentionally having carried out an intercourse" with an unnamed woman "by unduly exploiting that she was in a helpless state because of sleep", according to court documents.

Monday's ruling means the Swedish prosecutor can not at this stage request his extradition from Britain.

The United States is also seeking his extradition.

Responding to Monday's ruling, Persson said she has not decided whether to appeal.


"Well, we would have to follow our own legal processes, just as the USA has to follow its own legal processes", Hunt said on CBS Sunday morning show Face the Nation yesterday.
